These Terms of Service govern your use of the Velocity Apps website at velocityappdevelopment.com and, except where an individual app says otherwise, the mobile applications we publish. By using this website or any of our apps, you agree to these terms.

Acceptance of Terms

By accessing this website, downloading one of our applications, or contacting us, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this website or our applications.

Users under 18 must have the consent of a parent or guardian to use our applications and to make any purchase.

Who We Are

Velocity Apps is a company registered in the State of Delaware, United States. We are an independent studio: we design, build, publish and operate our own mobile applications. We do not perform development work for third parties, and nothing on this website is an offer of development services.

These terms cover:

  • This website and everything published on it
  • The mobile and web applications published by Velocity Apps
  • Any support or correspondence between you and us

Individual applications may have their own terms of service or end user licence agreement, published in the app or on that app's website. Where an app's own terms conflict with these Terms of Service, the app's own terms govern your use of that app, and these terms continue to govern everything else.

Use of This Website

We grant you a limited, non-exclusive, non-transferable licence to access and view this website for personal and informational use. You may not:

  • Copy, modify or redistribute the content or code of this website
  • Use the website for any unlawful purpose
  • Scrape, harvest or bulk collect content or contact details from the site
  • Interfere with, overload or attempt to gain unauthorised access to the site or the systems behind it
  • Present the site or any part of it as your own

Our Applications

When you download one of our applications, we grant you a limited, non-exclusive, non-transferable, revocable licence to use that application on devices you own or control, for your own personal and non-commercial use, subject to these terms and to the rules of the app store you obtained it from.

You may not:

  • Copy, modify, translate or create derivative works of the application
  • Reverse engineer, decompile or attempt to extract the source code, except where that right cannot lawfully be excluded
  • Rent, lease, sell, sublicence or otherwise transfer access to the application
  • Remove or obscure any copyright, trademark or other proprietary notice
  • Use the application in any way that could damage, disable or impair it, or interfere with anyone else's use of it
  • Circumvent any licensing, authentication or payment mechanism

We may release updates, change features, or discontinue an application at any time. Where we discontinue an application that you have paid for, we will say so in advance where it is reasonably possible to do so.

What Velocity Apps Is Not

Unless an individual app states otherwise in writing, our applications are consumer software. They are not medical devices, diagnostic tools, emergency services, financial advisers or professional advisers of any kind. Our applications and this website do not:

  • Diagnose, treat, cure or prevent any medical condition
  • Provide medical, legal, tax or financial advice
  • Replace consultation with a qualified professional
  • Guarantee the accuracy of any forecast, prediction, estimate or third-party data shown

Always consult an appropriately qualified professional before making a decision that matters. If you are experiencing an emergency, contact your local emergency services.

Purchases and Subscriptions

Where an application offers a paid purchase or subscription, the price is displayed at the point of purchase, and the transaction is processed by the app store you bought it through. We do not receive or store your payment card details.

Unless the app states otherwise:

  • Subscriptions renew automatically until you cancel them
  • You cancel through your Apple App Store or Google Play account settings, not through us
  • Cancellation takes effect at the end of the current billing period
  • Free trial length is shown at the point of subscription, and billing begins when the trial ends unless you cancel first
  • Refunds are handled under the policies of Apple or Google, and we cannot issue a refund on their behalf
  • We may change pricing with notice, and a change never affects a billing period you have already paid for

Acceptable Use

When using our website or applications, you agree not to:

  • Break any applicable law or regulation
  • Upload or transmit malware, or anything designed to disrupt or damage software or hardware
  • Attempt to access another person's account or data
  • Use automated systems to access our services in a way that places unreasonable load on them
  • Harass, threaten or abuse anyone through any support or feedback channel we operate

You are responsible for activity that occurs through your account or device, for keeping your device and the app updated, and for the network connectivity that some features require.

Intellectual Property

The Velocity Apps name, logo, applications, website, source code, designs, text and graphics are owned by Velocity Apps and are protected by copyright, trademark and other intellectual property laws. Nothing in these terms transfers any ownership to you.

Our applications may include open source and third-party components, which remain subject to their own licences. Where an application includes such components, the relevant notices are available within that application or on request.

Content you create inside one of our applications, such as your own notes, logs or entries, remains yours. We do not claim ownership of it, and we do not use it for marketing.

Feedback

If you send us suggestions, feature requests or other feedback, you grant us the right to use it without restriction and without any obligation to compensate you. We appreciate it, and it frequently ends up in a release.

Privacy and Data

Your use of this website is subject to our Privacy Policy. Individual applications may publish their own privacy policy covering the data that app handles, and where they do, that policy governs the app.

Third-Party Services

This website and our applications rely on third-party services, which may include app stores, hosting and content delivery providers, payment processors, analytics providers, cloud backup services and data providers such as weather APIs. Your use of those services is subject to their own terms and privacy policies.

We are not responsible for the availability, accuracy, pricing or policy changes of third-party services, or for outages and data errors originating with them.

Disclaimers

This website and our applications are provided "as is" and "as available" without warranties of any kind, either express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that:

  • The website or any application will be error free or uninterrupted
  • Defects will be corrected within any particular time
  • Any forecast, prediction or third-party data shown will be accurate
  • Notifications or alerts will always be delivered, or delivered on time
  • Any application will meet your specific requirements

Limitation of Liability

To the maximum extent permitted by law, Velocity Apps and its officers, employees and contractors shall not be liable for:

  • Any indirect, incidental, special, punitive or consequential damages
  • Lost profits, lost revenue, lost data or loss of business opportunity
  • Personal injury or property damage arising from use of an application
  • Missed, delayed or inaccurate alerts, predictions or notifications
  • Decisions you make based on information provided by this website or an application
  • The acts, omissions or outages of third-party services

Our total aggregate liability arising out of or relating to these terms, this website or any application is limited to the greater of the amount you paid us for the relevant application in the twelve months before the claim arose, or one hundred United States dollars.

Nothing in these terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, and in those jurisdictions our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Velocity Apps against any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the website or an application, or your violation of any law or of the rights of a third party.

Termination

We may suspend or terminate your access to this website or any application immediately, without prior notice, for:

  • Violation of these Terms of Service
  • Fraudulent, abusive or unlawful activity
  • Requests by law enforcement or other legal obligations

You may stop using our services at any time by deleting the application and, where relevant, cancelling your subscription through your app store account.

On termination, your licence to use the application ends immediately. Subscriptions are not refunded except as required by law or by the policies of the app store you purchased through. Sections covering intellectual property, disclaimers, limitation of liability, indemnification and governing law survive termination.

Changes to These Terms

We may modify these Terms of Service at any time. If we make material changes we will notify you by:

  • Posting the updated terms on this page
  • Updating the "Last Updated" date at the top of this page
  • Notifying you in the relevant application where the change materially affects your use of it

Continued use after changes take effect means you accept the modified terms.

Governing Law

These Terms of Service are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Where mandatory consumer protection law in your country of residence gives you rights that cannot be overridden by contract, those rights are unaffected.

Dispute Resolution

For any dispute relating to this website or our applications:

  • First, contact us at [email protected] so we can try to resolve it directly. Nearly everything is resolved at this stage.
  • If the dispute is not resolved within 30 days and it concerns a purchase, it will be handled under the dispute procedures of the Apple App Store or Google Play, depending on where you bought it.
  • Any remaining dispute will be heard in the state or federal courts located in the State of Delaware, and both parties submit to the exclusive jurisdiction of those courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any terms published for an individual application, constitute the entire agreement between you and Velocity Apps regarding the subject matter, and supersede any prior discussions or representations.
